A Proven Track Record
Some of Attorney Mark Kaiman’s recent successfully litigated cases:
- A property owner was sued by his Homeowner’s Association because he installed gate posts at the end of his driveway. The homeowner counter-sued the Association, and ended up owning the road in the subdivision where his house was located. He deeded the road back to the HOA in exchange for very favorable settlement terms. He got to keep the gate posts, too.
- Homeowner sued his contractor for breach of contract, fraud, conversion (theft) and other claims related to the contractor’s misdirection of construction loan proceeds. An arbitrator found that the contractor had failed to pay subcontractors, had committed fraud, and had engaged in unfair and deceptive business practices. Our client was awarded judgment in the amount of $419,676.00
- The Buyer in an installment contract sued our clients for a refund of $500,000 in payments made towards a $725,000 purchase before he defaulted. The court ruled in favor of the Sellers at a summary judgment motion. The court ruled that the payments were non-refundable, and our clients were allowed to keep the $500,000, as well as the real property that was the subject of the transaction.
